Practical Application of the Hierarchy

When a patient lacks capacity, the clinician's first action is to check whether the patient has an advance directive, health care power of attorney, or other documented expression of health care preferences. If such a document exists, it takes precedence over the statutory hierarchy. The named agent or the expressed preferences in the directive control the decision-making process.

If no advance directive exists, the clinician must identify whether a court-appointed guardian exists for the patient. If one does, the guardian has authority. If no guardian exists, the clinician approaches the next available tier in the hierarchy. For spouses, domestic partners, adult children, parents, and other family members, there is no requirement for documentation; the relationship itself confers surrogate authority.

The Unanimity Rule

An important feature of Washington's statute is the unanimity rule: when multiple individuals exist at the same tier in the hierarchy (e.g., multiple adult children, multiple siblings), all must agree on the surrogate decision. If they cannot reach consensus, the clinician cannot rely on surrogate authority from that tier and must escalate the matter to hospital ethics committees or seek court guidance. This requirement reflects the principle that surrogacy should reflect the patient's likely wishes or best interests—a determination that gains legitimacy when multiple family members concur.

Substituted Judgment vs. Best Interests Standard

Statutory Limitations on Surrogate Authority

Washington law imposes specific limitations on what surrogates can authorize. Notably, a surrogate cannot authorize the administration of medication for purposes of capital punishment, sterilization except in specific medical contexts, psychosurgery, or organ transplantation without clear and convincing evidence of the patient's prior wishes. Additionally, under Washington's Death with Dignity Act (RCW 70.245), surrogates cannot authorize physician-assisted dying on behalf of an incapacitated patient. Only the patient themselves, exercising capacity, can authorize medical aid in dying.

The Close Friend Provision: Requirements and Limitations

One of Washington's innovations is statutory recognition of close friends as surrogates of last resort. When No Surrogate Is Available

In some cases, no surrogate can be identified. The patient has no living family members, no close friends who are willing and able to serve, and no court-appointed guardian. How should the clinician proceed?

Washington law provides for court-appointed guardianship under Chapter 11.130 RCW as the mechanism of last resort. A clinician or hospital can petition the court for emergency guardianship, which expedites the usual guardianship process. The court will appoint a guardian ad litem to investigate the patient's circumstances and make a recommendation to the court. In emergency situations, the court can appoint a temporary emergency guardian pending a fuller guardianship proceeding.

For complex cases involving vulnerable populations—unaccompanied minors, homeless individuals with no known family or friends, patients with severe psychiatric illness and no surrogates—ethics consultation is standard practice.

Washington also has specific statutory provisions for unaccompanied minors lacking parental authority. The Department of Children, Youth, and Families (DCYF) can be involved to establish guardianship or to authorize medical decisions in emergency contexts. Similar provisions exist for certain populations under dependency proceedings.

Clinical Recommendations and Best Practices

Competent practice in surrogate decision-making requires both legal knowledge and clinical judgment. The following recommendations reflect evidence-based best practices:

Proactive Advance Planning: Every clinician should encourage competent patients to complete advance directives, health care powers of attorney, and mental health directives. The time to clarify a patient's values and designate a surrogate is when the patient is well and thinking clearly, not in the midst of acute illness or incapacity. Identify and Verify Surrogates: Do not assume surrogate authority. Ask the patient or family members directly: "Is there an advance directive or health care power of attorney?" "Are you the legal surrogate?" Verify documentation when available. In cases where surrogate authority is unclear—for example, when a close friend presents and claims surrogate status—request the signed declaration and verify that the attestation is genuine and within the six-month validity window.

Clarify the Patient's Known Wishes: Even in discussions with surrogates, center the conversation on what the patient would have wanted. Ask the surrogate: "Did [patient] ever express preferences about this kind of situation?" "What did [patient] value most?" "How did [patient] approach medical decisions?" Substituted judgment should guide decision-making when the patient's wishes are known or knowable.

Consult Ethics Committees for Complex Cases: For situations involving family conflict, contested surrogate authority, decisions at the end of life, decisions that deviate from the surrogate's personal values, or any case where you feel ethically uncertain, involve your hospital's ethics committee or ethics consultant. Ethics consultation does not slow decision-making; it clarifies it and provides institutional support for defensible decisions.

Provide Clear Communication and Education: Surrogates are often distressed, grieving, and uncertain about their responsibilities. Explain the decision-making framework, clarify that the surrogate's role is to represent the patient's values (not to impose the surrogate's own preferences), provide clear information about options, and support the surrogate's decision-making process. Families appreciate clinicians who take time to ensure understanding.
